In Savannah, Georgia, the aftermath of the January 6, 2021 Capitol attack continues to unfold as legal proceedings against former resident Dominic Box reach a turning point. Federal prosecutors are asking a court to render a verdict in the case against Box, who was initially charged with four misdemeanor offenses for his involvement in the insurrection.
Box made headlines when he captured himself on Facebook Live as he breached the restricted perimeter and entered the U.S. Capitol during the historic attack. According to a statement of facts from an FBI special agent, Box didn’t just wander around incognito; he actively documented his unlawful actions on social media.
During a voluntary interview with the FBI on February 10, 2021, Box confirmed his identity in the video footage, acknowledging he was the one livestreaming his Capitol escapade. This evidence later found its way into an HBO documentary titled “Four Hours at the Capitol,” where Box was featured and interviewed.
By the end of February 2024, the situation escalated when a second indictment came down the pipeline. This time, Box faced not just misdemeanors but also three felony counts, including obstruction of an official proceeding and two counts related to civil disorder. His legal rollercoaster was beginning to resemble a complex courtroom drama.
Representing Box, attorney Amy Collins sought to dismiss one of the felony counts, specifically the charge of obstructing an official proceeding. She argued in court filings that the count was “unconstitutionally overbroad” and lacked clear specificity. This was a strategic move to potentially lessen the legal fallout for her client.
In May 2024, Box itself filed a motion to dismiss this key obstruction charge, but the ruling came in June when Judge Colleen Kollar-Kotelly denied it. However, by September, U.S. attorneys agreed to drop the charge at sentencing, which indicated a willingness to streamline the case.
In a recent court filing dated September 23, the U.S. Attorneys expressed their aim for efficiency, signaling a desire for the court to reach a verdict on the remaining counts and proceed to sentencing. The government also indicated they would dismiss the obstruction charge assuming Box is convicted of other counts.
Interestingly, Box had previously signed a plea agreement in October 2023 to plead guilty to one count of obstruction. Yet, in a twist, he withdrew that plea in December 2023 after the U.S. Supreme Court agreed to hear a related case, United States v. Fischer. His then-attorney claimed this case directly impacted Box’s charges, hinting at a possible change in defense strategy.
